About these terms

These Terms & Conditions apply to services provided by LR Creative to its clients.

Additional terms may also be contained in a quotation, invoice, proposal, service agreement, project brief or other written communication issued by LR Creative.

If there is a conflict between these Terms & Conditions and a specific written agreement between LR Creative and a client, the specific written agreement will apply to the extent of that inconsistency.

02

  • e-commerce support;

  • other agreed digital creative services.

The exact services provided will depend on the scope agreed between LR Creative and the client.

03

Quotes, proposals and project scope

Any quotation or proposal is based on the information available at the time it is prepared.

If the scope of work changes, additional work may be quoted or charged separately. This may include additional pages, features, custom development, content creation, product uploads, revisions, integrations or other services that were not included in the original scope.

Work outside the agreed scope will only be undertaken where requested or approved by the client.

04

Payments

Fees, payment schedules and due dates will be set out in the relevant quotation, invoice, proposal or service agreement.

Clients are responsible for paying invoices by the due date stated on the invoice.

LR Creative may pause work or withhold delivery of work where an invoice remains overdue.

Any third-party costs, subscriptions, platform charges, applications, domains, licences, transaction fees, advertising costs or other external expenses are the responsibility of the client unless specifically stated otherwise in writing.

05

Client responsibilities

Clients are responsible for supplying the information and materials reasonably required for LR Creative to complete the agreed work.

This may include logos, brand assets, imagery, product information, pricing, policies, website access, platform access, account permissions and approvals.

The client is responsible for ensuring that any text, images, trademarks, photographs, product information and other materials supplied to LR Creative may lawfully be used.

The client is also responsible for checking important business information such as prices, product details, shipping information, trading hours, policies and promotional terms before publication.

06

Project timelines

Any timeframe provided by LR Creative is an estimate unless expressly stated otherwise in writing.

Project timing may depend on the client providing content, approvals, access and feedback within a reasonable timeframe.

Delays in receiving required information or approvals may result in the project timeline being extended.

LR Creative is not responsible for delays caused by third-party services, website platforms, applications, hosting providers, domain providers, payment providers or circumstances outside our reasonable control.

07

Revisions and approvals

Revisions will be handled in accordance with the scope of the relevant project or service.

Where a project includes a specified number of revisions, additional revisions or substantial changes outside the agreed scope may incur additional fees.

Once a client approves content, artwork, website layouts or other work, LR Creative may proceed on the basis of that approval.

Changes requested after final approval or launch may be treated as additional work.

08

Ongoing website management

Where LR Creative provides ongoing website management, the services included will depend on the client's agreed management arrangement.

Website management may include product updates, collection updates, homepage changes, promotional content, banners, navigation, campaign changes and other agreed website work.

Work that falls outside the agreed management arrangement may be quoted or charged separately.

Unless otherwise agreed, the client remains the owner and operator of their website, accounts and business systems.

09

Third-party platforms and services

LR Creative may work with third-party platforms and services such as Shopify, Ecwid, Mailchimp, Shopify Email, domain providers, payment gateways, applications and other software.

These services are operated by independent third parties and are subject to their own terms, pricing, availability and technical requirements.

LR Creative does not control and cannot guarantee the continued availability, functionality, security or pricing of any third-party platform or service.

Changes made by a third-party provider may require additional work to a client's website or digital setup.

10

Intellectual property

Unless otherwise agreed in writing, LR Creative retains ownership of its pre-existing intellectual property, working methods, reusable code, systems, processes, templates and know-how.

Once all amounts owing for a project have been paid, the client may use the final work created specifically for their business for its intended purpose.

Third-party software, themes, fonts, applications, stock imagery or other licensed materials remain subject to the rights and licence conditions of their respective owners.

11

Portfolio and promotional use

Unless otherwise agreed in writing, LR Creative may display completed work, screenshots, website designs, digital creative and project details in its portfolio, website, social media, proposals and other promotional material.

Confidential information or information that has not yet been publicly released will not knowingly be disclosed as part of portfolio use.

12

Cancellations and project changes

If a client wishes to cancel, postpone or significantly change a project, they should notify LR Creative as soon as possible.

The client remains responsible for payment for work already completed, approved expenses already incurred and any other amounts payable under the relevant quotation, invoice or service agreement.

Any refund entitlement will depend on the circumstances, the work already completed, the applicable agreement and any rights available under Australian law.

13

Results and warranties

LR Creative will provide services with reasonable care and skill.

However, website design, email marketing, e-commerce support and digital creative do not guarantee any particular level of sales, revenue, website traffic, enquiries, search engine ranking, customer engagement or other commercial result.

Business performance may be affected by factors outside LR Creative's control, including pricing, products, market conditions, advertising, stock availability, customer demand and third-party platforms.

14

Limitation of liability

To the extent permitted by law, LR Creative is not responsible for indirect or consequential loss arising from the use of services, websites, third-party platforms or digital systems.

LR Creative is not responsible for losses caused by third-party outages, hacking, malware, account compromise, platform changes, incorrect information supplied by the client, unauthorised changes made by others or circumstances outside LR Creative's reasonable control.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded.

15

Australian Consumer Law

These Terms & Conditions do not exclude, restrict or modify any rights or guarantees available to a client under the Australian Consumer Law or any other applicable law where those rights cannot lawfully be excluded.

Where a statutory guarantee applies, LR Creative's obligations will be determined in accordance with the applicable law.

16

Confidentiality

LR Creative will take reasonable care with confidential business information provided by clients for the purpose of completing agreed work.

Clients should avoid sending passwords or other sensitive account credentials through insecure channels where a safer access method is available.

Where possible, platform collaborator access, staff access or other secure access methods should be used.

17

Changes to these terms

LR Creative may update these Terms & Conditions from time to time to reflect changes to services, business practices or legal requirements.

The version published on the LR Creative website will apply from the date stated at the top of the page, unless another agreement applies to an existing client engagement.

18

Governing law
